Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Tisk ("we," "our," or "us") governing your use of the Tisk mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

Tisk is a task management and focus application designed to help you organize your tasks, manage your time, and block distracting applications to improve productivity. The App includes features such as task creation and management, focus mode, and app blocking capabilities.

User Accounts

To use certain features of the App, you may be required to create an account. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App's functionality or servers
• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit malware, viruses, or harmful code
• Use automated systems or software to extract data from the App
• Impersonate any person or entity or misrepresent your affiliation

Intellectual Property

The App and its original content, features, and functionality are owned by Tisk and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, distribute, or create derivative works based on the App.

User Content

You retain ownership of any content you create within the App, such as tasks, notes, and settings ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the App's services to you.

You are solely responsible for your User Content and represent that you have all necessary rights to such content.

App Store Terms

If you downloaded the App from the Apple App Store or Google Play Store, you also agree to comply with their respective terms of service. These Terms are between you and Tisk only, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the App or its content.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted, secure, or error-free operation
• Accuracy or reliability of any information obtained through the App

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TISK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify, defend, and hold harmless Tisk and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will cease immediately. You may terminate your account at any time by deleting the App and contacting us to request account deletion.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Canada.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tisk regarding your use of the App and supersede any prior agreements or understandings.
